Smart Defense Strategy” in Response to AED 80 Million Claim.

Outcome Summary: The Court ruled in favor of the defense by declaring the claim inadmissible due to prescription (expiry of the statutory limitation period), resulting in the complete dismissal of the AED 80 million claim. The claimant was ordered to bear all court fees, expenses, and legal costs.

 In a highly complex financial dispute involving claims amounting to approximately AED 80 million, the claimant made extensive efforts to attribute liability to our clients, alleging “fraud and misappropriation of commercial cheques” valued at more than AED 42 million. To strengthen his position, the claimant relied on a final criminal judgment convicting one of the parties in the same matter, assuming that such judgment would constitute decisive and conclusive evidence.

However, amid the intensity of the allegations and the magnitude of the amounts involved, our legal team intervened to recalibrate the course of the dispute and redirect it onto its proper legal track.

Legal Acumen That Altered the Course of the Dispute

We did not limit our review to the apparent form of the allegations; rather, we examined the case file in its full depth and detail. Through a precise and comprehensive analysis of the proceedings from the date of issuance of the criminal judgment up to the filing date of the civil claim we developed a defense strategy grounded in a set of substantive legal objections that significantly undermined the foundation of the case. The most prominent among these were:

The defense of limitation (prescription), based on the expiry of the statutory limitation period;

Lack of standing in relation to one of the claimants;

Lack of jurisdiction with respect to a company subject to insolvency proceedings;

The existence of prior disputes arising from the same underlying facts, which fragmented and weakened the coherence of the current claim.

The Court’s Ruling: Judicial Resolution in Favor of the Defense

After careful examination of the facts and supporting documents, the Court upheld the core defense arguments advanced by our legal team. 

The Court established a decisive finding in its reasoning: the claimant had full knowledge of the alleged harm and of the party responsible since the issuance of the final criminal judgment in 2017. Nevertheless, the claimant failed to initiate any legal proceedings within the statutory limitation period prescribed by law. Accordingly, the claim was deemed inadmissible for having been filed outside the legally prescribed timeframe.

The Court further affirmed a fundamental legal principle:

“Even where the underlying act is established by a final criminal judgment, parties remain bound by the statutory limitation periods governing civil claims.”

 Final Outcome: Complete Dismissal of the Claim

The Court concluded its judgment by ruling that the case was inadmissible due to prescription (expiry of the limitation period), and ordered the claimant to bear all court fees, expenses, and legal costs.

Accordingly, the limitation defense carefully structured and strategically advanced by our legal team—served as the cornerstone in dismantling the opposing party’s allegations and securing the full dismissal of the multi-million-dirham claim.
